ARVITRAGE TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By creating an account or using ARVitrage, you agree to these Terms. If you do not agree, do not use the platform.
2. DESCRIPTION OF SERVICE
ARVitrage is a real estate investment analysis platform that provides tools for deal analysis, lead scoring, rehab cost estimation, and related features. The platform uses artificial intelligence (via Anthropic's Claude API) to generate summaries, enrichments, and scores.
3. NO INVESTMENT ADVICE — IMPORTANT
ARVitrage is an analytical tool, not an investment advisor. ALL analyses, scores, valuations, ARV estimates, rehab cost estimates, profit projections, risk scores, and AI-generated content are ESTIMATES ONLY and are provided for informational purposes.
WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ANALYSIS, SCORE, OR PROJECTION GENERATED BY THE PLATFORM.
Real estate investing involves substantial risk, including the potential loss of your entire investment. You are solely responsible for your investment decisions. Always conduct your own due diligence, inspect properties in person, obtain professional appraisals, and consult with qualified professionals before making investment decisions.
AI-generated content is produced by a large language model and may contain errors, omissions, or inaccuracies. Do not rely on AI-generated content as the sole basis for any investment decision.
4. ACCOUNTS
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old.
5. SUBSCRIPTION AND PAYMENT
Paid plans are billed monthly through Stripe:
- ARVitrage Analyze: $29/month
- ARVitrage Intel: $79/month
- ARVitrage Pro: $199/month
Overage charges apply when you exceed your plan's included analyses. Plan changes are prorated. You may cancel at any time; cancellation takes effect at the end of your current billing period.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
6. YOUR DATA
You retain ownership of all property data, deal information, and other content you input into ARVitrage. By using the platform, you grant us a limited license to process your data solely for the purpose of providing the service, including sending data to third-party APIs (Anthropic) for AI processing.
You may export or request deletion of your data at any time.
7. ACCEPTABLE USE
You agree not to:
- Use the platform for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code
- Use automated tools to scrape or extract data from the platform
- Share your account credentials with others
- Resell access to the platform without our written consent
- Submit false, misleading, or fraudulent property data
- Exceed rate limits or abuse API access (Pro tier)
8. INTELLECTUAL PROPERTY
ARVitrage, its design, features, and underlying technology are our intellectual property. Your use of the platform does not grant you ownership of any platform IP. Analyses and reports generated from your data are yours to use.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARVITRAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSSES ARISING FROM INVESTMENT DECISIONS MADE USING THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. DISCLAIMER OF WARRANTIES
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. INDEMNIFICATION
You agree to indemnify ARVitrage against any claims, damages, or expenses arising from your use of the platform or your violation of these Terms.
12. TERMINATION
We may suspend or terminate your account for violation of these Terms or for any reason with 30 days' notice. Upon termination, you may request export of your data within 30 days.
13. GOVERNING LAW
These Terms are governed by the laws of the State of Colorado.
14. CHANGES TO TERMS
We may update these Terms with 30 days' notice. Continued use after changes constitutes acceptance.
